This is a case of misuse of privilege of bail. Earlier the petitioner was granted regular bail in connection with C-II 469 of 2003, Tr. No. 72 of 2016 registered under Sections 33, 41 and 42 of the Bihar Forest Amendment Act.

It is submitted that because of misuse of the privilege of bail, the petitioner is in custody since 11.06.2016. 4.
I, therefore, direct the petitioner, above named, be released on bail on furnishing bail bond of Rs. 5,000/- (Five Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Siwan in connection with C-II 469 of 2003, Tr. No. 72 of 2016 on condition that one of the bailor must be his close relative and the other be his co-villager and that he shall remain present on each and every date during the course of the trial in
Patna High Court Cr.Misc. No.35070 of 2016 (2) dt.20-08-2016 the court below. If the petitioner fails to remain present on two consecutive dates during the course of the trial without any reasonable cause being shown, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
