The petitioner seeks bail in a case registered for the offence under Sections 399, 402, 413, 414 of the Indian Penal Code, Sections 25(1-b)a, 26, 35 of the Arms Act and Sections 8, 20, 22 of the N.D.P.S. Act.

On secret information, a raid was conducted and eleven persons including petitioner were apprehended on the spot and on search, contraband articles and arms & ammunition have been recovered.

It is submitted on behalf of petitioner that no incriminating article has been recovered from the possession of the petitioner. It is apparent from bare perusal of the seizure list that contraband articles and arms & ammunition have been recovered from the possession of other co-accused persons and petitioner is in custody since 21.05.2021.

Patna High Court CR. MISC. No.62364 of 2021(3) dt.04-04-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. - I, Muzaffarpur in connection with Sahebganj P.S. Case No. 233 of 2021.
