JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 29-03-2016 After some argument, the learned counsel appearing on behalf of the petitioner, in presence of the learned AC to G.P. 30 appearing on behalf of the respondent no. 1 to 4, seeks permission to withdraw the present writ petition with a liberty to approach the competent authority i.e. the D.C.L.R., Gopalganj, under the provisions of The Bihar Land Disputes Resolution Act, 2009 (In short 'Act, 2009') for grant of appropriate relief(s) with respect to the lands, fully detailed in paragraph-4 of the writ petition, claimed by him.
Permission is accorded.
The writ petition stands disposed of as withdrawn with the liberty aforesaid.
Patna High Court CWJC No.7860 of 2015 (2) dt.29-03-2016 2/2 It goes without saying that if an appropriate petition is filed on behalf of the petitioner under the provisions of the Act, 2009, after impleading all the necessary parties, then the competent authority shall be obliged to consider and decide the claim of the petitioner strictly in accordance with law, but before passing any final order, an opportunity of hearing must be given to all concerned.
It is also clarified that if such a petition is filed within a period of one month from today with a certified copy of the present order, then the competent authority shall make all endeavours to dispose of the same at an early date preferably within a period of three months from the date of filing such petition.
