Public Prosecutor as well as Sri Nikesh Kumar, learned counsel for Opp.Party no.2/ South Bihar Power Distribution Company Ltd.

Three petitioners, who are in custody in connection with Maranchi P.S. Case no.11 of 2016 registered for the offence under Sections 147, 149, 323, 307, 353, 379 of the Indian Penal Code and Section 135 of the Electricity Act, have prayed for grant of bail.

It was submitted by learned counsel for the

Patna High Court Cr.Misc. No.31882 of 2016 (2) dt.16-08-2016 2/2 petitioners that so far as petitioner no.3/ Munni Lal Sao @ Munni Lal is concerned, he was earlier directed to be released on bail in the event of his arrest/surrender by order dated 01.07.2016 vide Cr.Misc.No.26087 of 2016, which was filed along with other two accused persons. However, before release, the petitioner no.3 was already arrested on 20.06.2016 and since then he is in custody. So far as petitioner nos. 1 and 2 are concerned, they are in custody since 20th June, 2016 and 02.07.2016 respectively. It has further been submitted that petitioners were not meter holders. However, in view of order passed by a Bench of this Court, while granting anticipatory bail, certain amount has already been deposited.

Keeping in view nature of accusation and the fact that petitioners are in custody, let the petitioners, namely, (i) Sanjay Sao (ii) Manoj Sao and (iii) Munni Lal Sao @ Munni Lal be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Deepak Kumar, learned Judicial Magistrate 1st Class, Barh, Patna, in connection with Maranchi P.S. Case no.11 of 2016.
