Heard the learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Sections 341, 323, 324, 379, 504, 506

Patna High Court CR. MISC. No.52236 of 2022(2) dt.23-01-2023 2/3 and 447/34 of the Indian Penal Code, registered in connection with Sakri P.S.Case No.170 of 2022.

As per allegation, five accused persons, named in the FIR, came to the darwaza of the informant and assaulted the informant and his brother. There is allegation that petitioner no.5 Md. Mojahid assaulted Md. Akbar with a rod on his head. The learned counsel for the petitioners has submitted that there is case and counter case. There is land dispute between the parties. Both the parties are agnates. They are number of cases between the parties. He has submitted further that the injuries suffered by the injured persons are simple in nature.

Considering the above facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of learned CJM, Madhubani in connection with Sakri P.S.Case No. 170 of 2022, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided
