JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 11-08-2025 Both these cases arise out of the same case i.e. Purnea Sadar P.S. Case No. 231 of 2025 and accordingly, they are being heard together and disposed of with this common order.

2. Heard learned counsels for the petitioners and learned APP for the State.

3. The petitioners seek of bail in a case registered for

Patna High Court CR. MISC. No.48153 of 2025(2) dt.11-08-2025 2/3 the offence punishable under Sections-25(1B)(a), 26, 35 of the Arms Act.

4. According to the FIR, the petitioner, Arvind Kumar Rai @ Arvind Kumar was arrested and from dicky of his motorcycle, a country-made pistol and two live cartridges were recovered. On disclosure made by Arvind Kumar, the house of the petitioner, Vikash Kumar was searched and 50 live cartridges were recovered from there.

5. It has been submitted on behalf of the petitioner, Vikash Kumar that he was not arrested at spot. Only cartridges were recovered from house of this petitioner. The motorcycle whereby the petitioner Arvind Kumar Rai was travelling was belonging to the petitioner, Vikash Kumar and that is why, the petitioner Vikash Kumar has falsely been implicated in this case. The petitioners are not involved in any other case of similar nature, and they are in custody since 11-05-2025.

6. Learned counsel for the petitioner Arvind Kumar Rai has submitted that he is a person of clean antecedent and he is under custody since 11-05-2025.

7. Learned APP has opposed the prayer for bail.

8. Considering the aforesaid facts and circumstances, let the petitioners named above, be released on bail on

Patna High Court CR. MISC. No.48153 of 2025(2) dt.11-08-2025 3/3 furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate/concerned court, Purnea in connection with Purnea Sadar P.S. Case No. 231 of 2025 with following conditions:

(i) The petitioners shall cooperate with the trial of the case and make themselves available as and when required by the court.

(ii) Before accepting the bail bond of the petitioners, the learned court below shall verify the criminal antecedent of the petitioners.
