The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections302, 120(B), 34 of the Indian Penal Code and section 27 of the Arms Act.

It is a case of commission of murder of the elder son of the informant.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. The petitioner was not named in the FIR and his name surfaced during investigation. The specific

Patna High Court CR. MISC. No.62115 of 2021(4) dt.06-09-2022 2/2 accusation of shot firing to the deceased is against Khargosh @ Rohit Kumar. There is no material evidence collected against the petitioner during investigation. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, II, Patna in connection with Buddha Colony P.S.
