JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-10-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections-325, 307 & other minor sections of the Indian Penal Code and 27 of the Arms Act.
Petitioners are ladies and are languishing in jail custody since 29-07-2016 on the accusation that they also participated in assaulting the informant.
No doubt, the informant sustained altogether nine injuries and the doctor opined that three injuries were simple in nature caused by sharp cutting weapon whereas; opinion regarding the rest injuries was kept reserved.
The impugned order goes to show that till date of passing impugned order, the prosecution could not succeed to
Patna High Court Cr.Misc. No.47052 of 2016 (2) dt.27-10-2016 2/2 place the complete injury report of the informant. Moreover, considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Lakhisarai P.S. Case No. 408 of 2016 to the satisfaction learned Chief Judicial Magistrate, Lakhisarai.
