JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302/34 of the Indian Penal Code.
Petitioner, who happens to be agnate of the informant, is named in the first information report and there was land dispute between the parties since long. The informant is not eye witness nor any witness appears to have come and claim himself to be eye witness of the alleged occurrence. Therefore, it appears that only suspicion has been raised against the petitioner who is languishing in jail custody since 08-07-2016. Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs.
Patna High Court Cr.Misc. No.40417 of 2016 (2) dt.29-09-2016 2/2 10,000/- (ten thousand) with two sureties of the like amount each in connection with Araria (Bairgachhi) P.S.
