JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 23-11-2022 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 147, 149, 341, 342, 323, 324, 325, 307, 354(B), 447, 448, 427, 504 and 506/379 of the Indian Penal Code.

In para no.2 of the petitioner, it has been submitted that earlier the petitioner had moved for grant of anticipatory bail along with others vide Cr. Misc. No. 57971/2021 but his application was dismissed as withdrawn on 11.05.2022 by this Court due to misunderstanding of the petitioner. Allegedly, the allegation against the petitioner is that he assaulted to the informant by means of farsa. It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.52080 of 2022(3) dt.23-11-2022 2/2 that the petitioner has falsely been implicated in this case. He further submits that the injury of the informant as alleged in the FIR by this petitioner is simple in nature as opined by the doctor. Petitioner has clean antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Jokihat P.S. Case No. 305 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U
