1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Tekari Police Station Case No. 249 of 2024, disclosing offences under Sections 341, 323, 353, 506, 34 of the Indian Penal Code.

3. As per the FIR, one tractor loaded with sand was intercepted by the dafadar which was being driven by coaccused Sonu Kumar. It has further been alleged that petitioner disclosed that Sonu Kumar disclosed that the tractor belongs to Shyama Kant Yadav, ex-Mukhiya, and he made a call, thereafter, the brother of Shyama Kant Yadav i.e. petitioner along with 8-10 persons arrived there, assaulted the informant and the chowkidar and took away the tractor before arrival of

Learned counsel for the petitioner submits that allegation of driving the tractor was upon Sonu Kumar and in the FIR also it has been stated that co-accused Sonu Kumar along with brother of Shyama Kant Yadav i.e., petitioner and 810 persons got the tractor free from the possession of the informant. The co-accused Sonu Kumar has been granted anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 82845 of 2024 vide order dated 10.12.2024.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that similarly situated co-accused person has been granted anticipatory bail by a Co-ordinate Bench of this Court, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Gaya, in connection with Tekari Police Station Case No. 249 of 2024, subject to the condition laid down under
