2.The instant application for regular bail has been filed by the petitioner in connection with Kharagpur P.S. Case no. 299 of 2013 instituted for the offence under Sections 25(1AA)/(1-AAA)/26(ii)/35 of the Arms Act and Sections 16,18,20 and 23 of the U.A.P. Act.
3. As per allegation in the FIR, on getting secret information about assembling of antisocial persons, police party encircled the house of accused Ratan Kumar and on chase two persons were apprehended on spot, who disclosed the name of other accused persons.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has

No incriminating article has been recovered from possession of the petitioner rather the recovery of arms have been made from the house of co-accused Ratan Kumar. Petitioner was not arrested on spot. His name surfaced in this case on the basis of confessional statement of apprehended accused. Petitioner is languishing in judicial custody since 17.09.2022.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.D.J. IV, Munger in connection with Kharagpur P.S. Case No. 299 of 2013.
