JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 332, 333 and 353/34 of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act.
It is alleged that the informant being a police officer went to pacify the dispute between the petitioner and others when petitioner assaulted with bamboo stick to the informant causing injury.
It is submitted by learned counsel for the petitioner that in fact the informant caused fracture injury on the right shoulder of the brother of the petitioner, the injury report of the brother of the informant has been brought on record as Annexure-2, and in order to save the skin, frivolous case has been lodged. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya in connection with Vishnupad P.S. Case No. 26 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
