2. Heard learned counsel for the petitioner and learned A.P.P for the State.

3. The petitioner has preferred this application for grant of regular bail in connection with Bachhwara P.S. Case No. 131 of 2023 dated 30.04.2023 registered for the offences punishable u/ss 341, 323, 307, 379, 504, 506 read with Section 34 of the Indian Penal Code.

4. As per the prosecution case, the petitioner and the co-accused persons holding lathi, danda and iron rod came to the door of the informant. The petitioner having intention to kill

Patna High Court CR. MISC. No.53220 of 2023(2) dt.25-08-2023 2/3 assaulted on the head of the informant's father with iron rod causing broken injury. The co-accused persons Manjay Rai assaulted on the head of the informant's brother and the coaccused Dropadi Devi took out Rs. 500/-from the pocket of his brother. It is further alleged that the accused persons used to make a plan to murder the informant and his family members. Two empty cartridges were also recovered from the place of occurrence.

5. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is further alleged that some altercation took place between the parties as a result of which, both parties have sustained injuries. Nothing has been recovered from the possession of the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 14.06.2023

6. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

7. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of
