Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 135 of the Electricity Act.

The accusation is of consuming electricity energy unauthorizedly by running three H.P. pumps and thereby causing loss to the tune of Rs. 1,60,230/- It is submitted by learned counsel for the petitioner that seizure appears to be malicious as the alleged H.P. pumps have not been seized which gets reflected from the F.I.R though it reflects seizure of four feet electrical wire and this fact has also not been controverted by learned counsel appearing on behalf of South Bihar Power Distribution Company Limited.

The petitioner undertakes to deposit rupees

Patna High Court Cr.Misc. No.23883 of 2015 (2) dt.03-07-2015 2/2 forty thousand which will be subject to the compounding or assessment proceeding.

Considering the aforesaid facts, on deposit of rupees forty thousand, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Electricity Magadh Area, Gay in connection with Barun P.S. Case No. 32 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
