The plaintiff is the petitioner in this application and is aggrieved by the order by which the learned court below has allowed the prayer of respondent no. 3 to be impleaded as intervenor-defendant in the suit.
After considering the submissions and the perusal of the impugned order, it is evident that the learned court below after considering the facts and circumstances of the case has come to the conclusion that respondent no. 3 has got interest in the suit land and
Patna High Court CWJC No.14470 of 2014 dt.18-10-2016 his presence before the court is necessary for determination of the issues arising in the suit. During the course of submission, the learned counsel for the petitioner could not establish as to how the impugned order will prejudice the interest of the plaintiff. This Court has not been persuaded to find any illegality or material irregularity in the impugned order.
The application is, accordingly, dismissed.
