The petitioner is in custody since 17.04.2016, in connection with Bhawanipur P.S. Case No. 66 of 2016, registered for offences punishable under Sections 457 and 380 of Indian Penal Code.
Allegation against the petitioner is of theft of welding machine.
It has been submitted on behalf of the petitioner that the petitioner has been implicated in the present case only on the basis of suspicion and the alleged welding machine has not been recovered from the possession of the petitioner rather the same was recovered from the field of one Ghanshyam Yaduka. The petitioner has been in judicial custody since 17.04.2016, without
Patna High Court Cr.Misc. No.53843 of 2016 (2) dt.15-12-2016 2/2 having any criminal antecedent.
Heard learned A.P.P. also.
Considering the aforementioned facts and circumstances, nature of offence, the period of custody and also that the petitioenr's name surfaced on this case only on the basis of suspicion, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri. M. Kumar learned Judicial Magistrate -1st Class, Purnea in connection with Bhawanipur P.S. Case No. 66 of 2016.
