1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 329(4), 115(2), 117(2), 109(1), 351(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. Learned counsel for the petitioners submits that the petitioners are persons with clean antecedents and the informant alleges that on account of a dispute relating to the falling of water, the accused persons including the petitioners came on his
Patna High Court CR. MISC. No.54852 of 2025(2) dt.03-09-2025 2/3 roof and started abusing and assaulted the informant with lathi and brick, causing injury on head and tooth. They further assaulted his mother, causing a fracture of her hand, thereafter assaulted Sudarshan, causing injury to his teeth and also assaulted Amit, causing injury on his head.
4. Learned counsel appearing on behalf of the petitioners submits that the petitioners have been falsely implicated in the instant case by the informant. It is next submitted that on account of a dispute related to the falling of water, an altercation took place in which both sides assaulted each other. It is also submitted that the injuries suffered by the injured persons are simple in nature. It is next submitted that even the allegation of assault is not specific, rather it is general and omnibus in nature.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, let the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like
Patna High Court CR. MISC. No.54852 of 2025(2) dt.03-09-2025 3/3 amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Mokama P.S. Case No. 111 of 2025, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

Accordingly, the instant anticipatory bail application stands allowed.
