Petitioner No. 1 being daughter-in-law of the informant and petitioner Nos. 2 and 3 being mother and brother of petitioner No. 1 are apprehending their arrest in a case registered for the offences punishable under Sections 365/34 of the Indian Penal Code.
The accusation is that son of the informant being husband of petitioner No. 1 was kidnapped by the in-laws family.
It is submitted by learned counsel for the petitioners that petitioner No. 1 at earlier point of time filed Complaint Case No. 460 of 2014 levelling accusation under Sections 232, 498A, 504 of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act. Hence as a retaliatory measure
Patna High Court Cr.Misc. No.23813 of 2015 (2) dt.10-07-2015 2/2 the present case has been lodged.
Considering the relationship between the informant and the petitioners and the case lodged by petitioner No. 1 at earlier point of time, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Simari P.S. Case No. 97 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
