The petitioner has been in custody since 22.07.2018 in connection with Harsidhi P.S. Case No. 295/2018 registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that actually there was no recovery from the possession of the petitioner, but the alleged recovery from the roadside opposite the house of the petitioner and, therefore, no case can be made out against the petitioner.

In view of the aforementioned facts and circumstances and that the petitioner is not having any criminal antecedent, let the petitioner above named, be released on bail on

Patna High Court Cr.Misc. No.57817 of 2018 (2) dt.20-09-2018 2/2 furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, East Champaran, Motihari, in connection with Harsidhi P.S. Case No. 295/2018.
