JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 20-02-2015 This application under Articles 226 and 227 of the Constitution of India has been filed for quashing of the first information report of Pirbahore P.S. Case No.135 of 2011 registered for the offences punishable under sections 419, 420, 120B, 474, 414 and 379 of the Indian Penal Code read with 27(b)(ii), 27(d), 36-AC, 28, 28-A of the Drugs and Cosmetics Act, 1940.

A counter affidavit has been filed on behalf of the State. Learned counsel for the State has submitted that on 12th January, 2015 the police have submitted report under section 173 of the Code of Criminal Procedure in the court of Magistrate concerned. Regard being had to the subsequent developments in the

Patna High Court Cr. WJC No.636 of 2014 (3) dt.20-02-2015 2/2 matter, learned counsel for the petitioner seeks leave to withdraw the present application in order to seek other remedies available in law.
