JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Parsauni P.S. Case No. 14 of 2019 registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504 and 34 of the Indian Penal Code.

Allegation against the petitioner is of assaulting the informant by knife on his chest and other accused persons assaulted him by means of spade.

Submission of learned counsel for the petitioner is that there is case and counter case and petitioner has also received injury and in the court below case diary was not produced, as such petitioner has no knowledge about the nature of injury sustained by informant but on instruction he has submitted that injuries on the person of informant are simple in nature.

In view of above facts and circumstances, this application is disposed of with direction to court below to verify the injury on the person of informant and if it is found to be simple in nature the court below will release the petitioner on bail on his appearance to its own satisfaction, otherwise the petitioner to pray for regular bail. It is, however, made clear that during the period the injury is examined by the court below, petitioner shall be released on provisional bail on his appearance.
