The petitioner is apprehending arrest in a case registered for the offences punishable under sections 341, 323, 504/34 of the Indian Penal Code and section 3(i)(v)(x) and (xv) of the S.C/S.T (Prevention of Atrocities) Act.
It is alleged that on protest being made for making ridge on the land of the informant, the accused assaulted the informant with legs and shoes and hurled abuses. It is submitted by the learned counsel for the petitioner that the accusation has been levelled in the background of serious land dispute for which proceedings under section 107 and 144 Cr. P.C. were initiated earlier and a Title Suit is pending
Patna High Court Cr.Misc. No.27303 of 2015 (2) dt.22-07-2015 between the parties. It is further submitted that for the occurrence of 23.12.2012 the F.I.R. has been lodged on 22.02.2013. Considering the aforesaid facts particularly delay in lodging the first information report and in the background of serious land dispute between the parties, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj (S.C./S.T.) P.S. Case No 08 of 2013 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973.
