The petitioner seeks bail in anticipation of his arrest in connection with Goh P.S. Case No. 139 of 2018 dated 01.07.2018 instituted for the offences under Sections 406, 409 and 420 of the Indian Penal Code.
The petitioner is sought to be prosecuted in this case in his capacity as Headmaster of Middle School, Lohri, where there has been a defalcation of approximately 21 lakhs of rupees which was sanctioned for the purposes of construction of the school building.
Patna High Court Cr.Misc. No.57799 of 2018(2) dt.11-12-2018 2/3 Learned counsel for the petitioner has submitted that he had taken charge of the Principal of the aforesaid school from one Rajendra Kumar only on 21.02.2015. The petitioner was never handed over the charge of the building construction and therefore the measurement book also could not be updated.
It has further been submitted that on the day when the petitioner took charge, total amount of approximately 18 lakhs was available in the bank account of the school and no amount admittedly has been withdrawn from the aforesaid account of the school at the instance of the petitioner. Considering the aforesaid facts, the petitioner above-named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Daudnagar, Aurangabad in connection with Goh P.S. Case No. 139 of 2018, subject to the conditions as laid down
