JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 14-12-2016 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner wants to renew his prayer of bail, which was earlier twice rejected vide order dated 17.03.2015 and 18.01.2016 passed in Cr. Misc. No. 46727 of 2014 and 52683 of 2015 respectively, on the ground that the petitioner is suffering in custody since 03.07.2014 and in near future the trial is not likely to be concluded, further medical evidence does not support the prosecution version to which the learned APP opposes by submitting that the petitioner is the assailant. In the facts and circumstances stated above, finding no good ground for reconsideration of prayer for bail of the petitioner, again his prayer for bail stands rejected in connection with Sessions Trial No. 923 of 2014 pending in the court of learned Additional Sessions Judge V, Munger.

No.53486 of 2016 (2) dt.14-12-2016 However, again learned trial court is directed to expedite the trial and conclude the same as early as possible, preferably within five months from the date of receipt/production of a copy of this order, failing which, the petitioner, if at no fault, may be at liberty to renew his prayer of bail.
