The sole petitioner apprehending his arrest in connection with Khusrupur P.S. Case No. 48 of 2017 , registered for the offence under Section 20/22 of the Narcotic Drugs And Psychotropic Substances Act, 1985 and Section 30 (A) of the Bihar Excise Amendment Act, 2016 has prayed for grant of bail in the event of his arrest or surrender. Learned counsel for the petitioner by way of referring to the F.I.R. submits that it is evident that one of the accused who was apprehended disclosed that he was the owner of the motorcycle from where Ganja as well as country made liquor
Patna High Court Cr.Misc. No.59931 of 2018(2) dt.06-10-2018 2/2 was shown to be recovered. He submits that petitioner is having no connection with the motorcycle in question and he has falsely been implicated, however on going through the F.I.R. it is evident that co- accused/ Gopal Kumar who has claimed to be the owner of the vehicle i.e. motorcycle in question has categorically said that the said motorcycle was being used by this petitioner, who is non else but elder brother of Gopal Kumar.
Considering the nature of accusation i.e. case relating to N.D.P.S. Act, there is no reason to entertain the prayer for grant of anticipatory bail The petition stands dismissed.
