2. The petitioner has prayed for bail in connection with Ahiyapur P.S. Case No. 229 of 2024 registered for the offence punishable under Sections 302 and 34 of the Indian Penal Code.

3. The case of the prosecution, in short, is that on 18.02.2024 at about 6:00 P.M., the son of the informant had gone to take vegetables. When he did not return till night then informant called on his mobile at 6:30 P.M. He told he will return within 10 minutes. After that the mobile of the informant's son got switched off. He was being searched by the family members. On 19.02.2024, the informant came to know that a dead body has been sent to SKMCH. When he came to

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. The F.I.R. was lodged against unknown miscreants. During course of investigation, one co-accused Arun Kumar has given his confessional statement and in his confessional statement, the name of this petitioner has surfaced. It has also been submitted that save and except the confessional statement of co-accused nothing is there against this petitioner. It has also been submitted that similarly situated co-accused Arvind Kumar has been granted bail by this Court vide order dated 03.03.2025 passed in Cr. Misc. No. 78516 of 2024. The case of this petitioner stands on similar footing. He is languishing in judicial custody since 04.04.2025.

5. Learned APP appearing for the State has also conceded to the argument of the learned counsel for the petitioner that there is nothing save and except the confessional statement of the co-accused.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named

No.50227 of 2025(3) dt.16-10-2025 3/3 petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 229 of 2024.
