JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 341,323,354,504 and 506 of the Indian Penal Code. It is alleged that for the protest being made for outraging the modesty of the niece of the informant, the petitioner assaulted the informant and his wife.

It is submitted by the learned counsel for the petitioner that injury has been found to be superficial in nature. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. It is further submitted that the informant has retracted from the initial version and has filed a petition to that effect before the Sarpanch.

No.28342 of 2015 (2) dt.23-07-2015 2/2 The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioners surrender within six weeks from today in connection with Barahiya PS. Case No. 138 of 2014 pending in the court of learned CJM, Lakhisarai.

This application is disposed of with the aforesaid observation/direction.
