The petitioner, who is in custody, seeks bail in connection with Hasanpur P.S.Case No. 117 of 2016 registered under Section 302/34 of the Indian penal Code. Prosecution case, in brief, is that informant's daughter was married 20 years back with one Naresh Yadav. Later on, he married to another lady in the year 2007. It is alleged that all the accused persons used to assault the sister of the informant and on the alleged date of occurrence, he got information that they have killed his daughter.

Learned counsel for the petitioner submits that the allegation is false and frivolous. It is stated that the petitioner is the resident of another village and he is the brother of the second

No.54169 of 2016 (2) dt.21-12-2016 2/2 wife of Naresh Yadav and has also no concern with his domestic affairs and from the FIR itself shows that there is no eye witness to this occurrence and the husband of his sister Naresh Yadav has been granted bail by a co-ordinate Bench of this Court vide order dated 08.12.2016 passed in Cr. Misc. No. 53125b of 2016 and the petitioner has got no criminal antecedent.

Considering the aforementioned facts and circumstances, the petitioner, named above, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Rosera at Samastipur in connection with Hasanpur P.S. Case No. 117 of 2016.
