The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 366A of the Indian Penal Code.
This petitioner is alleged to have kidnapped 17 years old daughter of the informant on the pretext of marriage. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner and daughter of the informant had performed marriage in Arya Samaj Mandir, Harit Vihar, Shastri Nagar, Ghaziabad which is evident from the Certificate of Registration of Marriage issued by the Marriage Registration Officer V,
Patna High Court CR. MISC. No.66049 of 2021(3) dt.15-04-2022 2/2 Ghaziabad (Annexure 2 series). Even informant in her restatement dated 12.1.2021 recorded during investigation, contained in paragraph 55 of the case diary, has stated that her daughter was carrying pregnancy and died of complication developed at the time of giving birth to a child. Petitioner has claimed clean antecedent and he is in custody since 26.6.2021. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in Bhagwan Bazar Police Station Case No. 503 of 2017.
