Patna High Court LPA No.954 of 2017 (5) dt.03-10-2018 2/2 appellant-original writ petitioner seeks permission to withdraw the present Letters Patent Appeal with a liberty to make a representation considering the observations made by the learned Single Judge in the second last paragraph of the impugned judgment and order, dated 24.05.2016, that "however, it is observed that as and when the vacancy will be created, the respondent will respond in a proper manner". Permission is, accordingly, granted.

The present Letters Patent Appeal stands dismissed as withdrawn.

As and when, any representation is made, the same shall be considered in accordance with law for which we have not observed anything in favour of the appellantoriginal writ petitioner, as even the learned Single Judge has also not observed anything in favour of the appellant-original writ-petitioner while making above observation.
