The application is for grant of bail for the offence under Sections 272, 273/34 of the Indian Penal Code as well as Section 47 of the Bihar Excise (Amendment) Act, 2016. It has been submitted on behalf of the petitioner that though it is alleged that 35 ltrs. of liquor country-made liquor have been recovered from the possession of the petitioner but there is no compliance of Section 100 of Cr.P.C. and the petitioner is in custody for about three months. It has also been submitted that the petitioner has no criminal antecedent.

Having heard both sides. In view of the fact that there is no compliance of Section 100 of Cr.P.C. and the petitioner is in

No.55451 of 2016 (2) dt.23-12-2016 2/2 custody for about three months, let petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of CJM, Saran, Chapra in connection with Panapur P.S.Case No.123 of 2016.
