The petitioners apprehend their arrest in connection with Amarpur P.S. Case No. 110 of 2019, registered under Sections 148, 149, 341, 323, 504 and 307 of the Indian Penal Code and Section 27 of the Arms Act, pending in the court of the Chief Judicial Magistrate, Banka. The accusation is that on 17.03.2019 at about 8.00 A.M. informant Rajeev Kumar was returning to his house, in the way, petitioner No.1 Santosh Singh and his brother-in-law Bijrendra Singh started to abuse the informant and caused injury at his chest through barrel of the rifle. Thereafter,

No.51119 of 2019(2) dt.17-08-2019 2/2 informant fled away towards his village Majhgai, but Bijendra Singh, Arbind Singh and Manoj Singh (Petitioner No.2) came firing through rifle in the village in which Sabitri Devi sustained firearm injury in her leg. On hearing the sound of firing, villagers rushed there then all accused fled away, but Binjendra Singh fell down.

Learned counsel appearing on behalf of the petitioners submits that while allegation has been made against the petitioner and other accused to cause injury to the informant, but specific allegation to cause firearm injury to Sabitri Devi is against Bijendra Singh.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioners, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, their prayer for grant of anticipatory bail stands rejected. The petitioners are directed to surrender before the trial Court within four weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
