Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366(A), 120B of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant. Though the petitioner was not named in the First Information Report and the victim filed a petition before learned Court below which has been brought on record as Annexure-3 where she stated that she named Vivek Srivastav who is a different person. Now the petitioner takes the stand that he has now married with the victim girl who is residing with the petitioner.

Considering the present stand of the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of

Patna High Court Cr.Misc. No.24433 of 2015 (2) dt.30-06-2015 2/2 one week, be released on provisional anticipatory bail for four weeks on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 782 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The petitioner will produce the victim girl before learned Court below on 8th of July, 2015 when learned Court below will record the statement of the victim girl and if she admits that she of her own married with the petitioner then the provisional bail of the petitioner will be confirmed, otherwise the petitioner will surrender and pray for regular bail.
