JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-05-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under sections 392 and 411 of the Indian Penal Code.

It is alleged that the petitioner along with other miscreants looted cash of Rs.2000/- and Nokia mobile from the possession of the informant when co accused Deepak Kumar Mandal was caught on the spot and others managed to escape. Name of the petitioner was suggested by co accused Deepak Kumar Mandal.

It is submitted by learned counsel for the petitioners that in fact it was a case of overtaking of the vehicle from the

Patna High Court Cr.Misc. No.17640 of 2015 (2) dt.18-05-2015 2/2 informant for which malicious case has been lodged. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Since other co accused has been granted regular bail, let the learned court below consider the prayer for regular bail of the petitioners in case the petitioners surrender within six weeks from today in connection with Narpatganj P.S Case No. 381 of 2014 pending in the court of learned J.M. Araria.

This application is disposed of with the aforesaid observation/direction.
