JUSTICE ARUN KUMAR JHA ORAL ORDER 23-08-2024 The instant petition has been filed for modification of order dated 09.06.2022 passed in Cr. Misc. No. 4990 of 2022 by this Court, whereby while granting bail to the petitioner one of the conditions was that the bail bond of the petitioner shall be accepted only after framing of charge.
2. Learned counsel for the petitioner submits that the charges have not been framed till date and the petitioner has been languishing in custody since 13.08.2021. Learned counsel further submits that considering the facts and circumstances, the condition regarding acceptance of bail bond after framing of charge may be waived.
3. Considering the facts in its entirety and long period of custody of the petitioner, condition no. 1 regarding
Patna High Court CR. MISC. No.58510 of 2024(2) dt.23-08-2024 2/2 acceptance of bail bond after framing of charge stands waived. The order dated 09.06.2022 stands modified to the extent indicated above.
4. However, learned trial court is directed to proceed in the matter showing some urgency as it is very unfortunate that the charges have not been framed despite the petitioner being in custody since 13.08.2021.
5. Accordingly, the present petition stands disposed of.
