JUSTICE RAKESH KUMAR ORAL ORDER 20-09-2018 Heard Sri Rajesh Kumar Mishra, learned counsel, assisted by Sri Nawal Kishor Singh , learned counsel for the petitioner and Sri Tapeshwar Sharma, learned Additional Public Prosecutor.
The sole petitioner, apprehending his arrest in connection with Pirbahor P.S. Case No. 130 of 2018, G.R. No. 1625 of 2018 , registered for the offence under Section 379 of the Indian Penal Code, 1860 , has prayed for grant of bail in the event of his arrest or surrender.
At the very outset, learned counsel for the petitioner has drawn my attention to the statement made in paragraph- 3 of the petition to show that petitioner is having clean antecedent. Besides this, it has been argued that in the F.I.R. it has been
Patna High Court Cr.Misc. No.58626 of 2018(2) dt.20-09-2018 2/2 alleged as if the petitioner in the examination of Sub Inspector of Police had taken away carbon copy of O.M.R. Sheet . Be that as it may, considering the nature of accusation and clean antecedent of the petitioner, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner - Shreekant Tiwary @ Shri Kant Tiwari be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna / concerned court in connection with Pirbahor P.S. Case No. 130 of 2018 ( G.R. No. 1625 of 2018 ) subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure, 1973.
