JUSTICE SUDHIR SINGH ORAL ORDER 26-09-2018 The present application has been filed for modification of the order dated 15.09.2017 passed in Cr.Misc.No.44500 of 2017, by which the petitioner was granted anticipatory bail in connection with Danapur P.S. case No.307 of 2016 pending in the court of A.C.J.M., Danapur, District Patna and the petitioner was directed to surrender and furnish bail bond in the court below within a period of six weeks. It is submitted on behalf of the counsel for the petitioner that the petitioner was suffering from jaundice and fever, as a result of which he could not furnish his bail bond. Earlier, first modification application, vide Cr.Misc.No.6198 of 2018, filed by the petitioner was allowed by

Patna High Court Cr.Misc. No.59189 of 2018(2) dt.26-09-2018 2/2 order dated 8.3.2018 with a direction to the petitioner to surrender in the court below.

In spite of the said order of the court, the petitioner did not surrender in the court below and hence the second application for modification of the anticipatory bail has been filed.

I find no merit in the present modification application. The same is dismissed.
