The petitioners seek bail in Narpatganj P.S. Case No.280 of 2018 registered under Sections 25(1-B)a, 26 and 35 of the Arms Act.

The informant got information that some persons assembled at the door of Tej Narayan Yadav on account of some dispute. The informant went there and arrested four persons, Tej Narayan Yadav, Sanjay Sharma, petitioner No.1, Kisan Sharma, petitioner No.2 and Rajesh Kumar. From the possession of Sanjay Sharma, one country made pistol with cartridges and from possession of Kisan Sharma also, one country made pistol with cartridges were recovered.

Patna High Court Cr.Misc. No.58668 of 2018 (2) dt.20-09-2018 Learned counsel for the petitioners submits that petitioners are in jail since 17.05.2018. Petitioners have got no criminal antecedent. A co-ordinate Bench of this Court ordered for release of co-accused Tej Narayan Yadav and Rajesh Kumar after completion of six months in custody.

Considering the facts aforesaid that the similarly situated co-accused have been ordered to be released on bail after completion of six months, the petitioners, above named, are directed to be released on bail after completion of six months in custody on furnishing bail bond of Rs.10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No.280 of 2018.
