2. The petitioner seeks bail in connection with Bithan P.S. Case No. 49 of 2024 registered for the offence punishable under Sections 8, 20(B)II B of N.D.P.S. Act.

3. As per the prosecution case, 3 Kg Ganja has been recovered from the house of one Dilkhush Kumar. The petitioner was also found sitting there.

4. It has been submitted by learned counsel for the petitioner that the petitioner being a co-villager had gone to take tea with Dilkhush and because of the recovery of ganja from the house of Dilkhush, he was also arrested. Another co-accused namely, Vishal Kumar who was also found at the place of occurrence i.e., in the house of Dilkhush Kumar has been

Patna High Court CR. MISC. No.58993 of 2024(2) dt.28-08-2024 2/2 granted bail on 21.08. 2024 in Cr. Misc. No. 57276 of 2024. The petitioner is in jail since 20.05.2024 having clean antecedent.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned District & Sessions Judge, Samastipur in connection with Bithan P.S. Case No. 49 of 2024.

7. The petitioner will also mark attendance in Bithan Police Station on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner.
