1. Heard learned Senior Counsel for the petitioner Mr. Krishna Prasad Singh assisted by learned counsel Mr. Amit Kumar, learned A.P.P. for the State Mr. Sucheta Yadav and learned counsel for the O.P. No.2 Mr. Amit Kumar.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 323, 341, 498(A) of the IPC.

3. Learned Senior Counsel for the petitioners submits that petitioner is a person with clean antecedent and the informant alleges that the petitioner was married to the complainant on 22.05.2022, and it is alleged that after marriage all the accused

Patna High Court CR. MISC. No.54387 of 2025(4) dt.23-09-2025 2/3 persons started assaulting the informant on account of nonfulfillment of demand of dowry of Pulsar motorcycle. The learned Senior Counsel submits that petitioner has been falsely implicated in the instant case by the complainant. It is next submitted that from perusal of the allegation as alleged in the complaint, it would manifest that the allegation of demand of dowry and torture is general and omnibus in nature. It is asserted and submitted that though it is alleged that petitioner and his family members assaulted the complainant but then it is the petitioner and his family members who have been ousted from their own home and they are staying on rent while the complainant is staying in the house of the petitioner.

4. The learned counsel appearing on behalf of the O.P. No.2 opposes anticipatory bail application but then is not in a position to rebut the submissions of the learned Senior Counsel for the petitioner that petitioner along with his family members is staying on rent while the complainant is staying in the house of the petitioner and his family members.

5. Considering the submissions made on behalf of the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing

No.54387 of 2025(4) dt.23-09-2025 3/3 bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Complaint Case No. 1255 of 2023, subject to the conditions as laid down under Section 482 (2) of BNSS.

6. Accordingly, the instant anticipatory bail application stands allowed.
