The petitioner is in custody in connection with Nautan P.S. Case No. 155 of 2018 for the offence under Sections 447, 341, 323, 324, 308, 504, 506/34 of the Indian Penal Code. Allegation against this petitioner is that he assaulted the informant by the rod on his head.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 04.04.2019. He further submits that on the same date due to land dispute Mar-pit has taken place and the petitioner's side has also filed case against the informant's side. Considering the fact that there is land dispute between the parties and both sides have sustained injury as well as the petitioner is in custody since 04.04.2019 having no criminal
