2. Petitioner seeks regular bail in connection with Riga P. S. Case No. 128 of 2025 in a case registered for the offences punishable under Sections 103, 61(2), 3(5) of the Bharatiya Nyaya Sanhita.

3. Prosecution case, in brief, is that on 30.03.2025 at about 8 PM, this petitioner along with his brother-in-law, coaccused Bikau Mukhia, came at the house of informant and took his son, namely, Raushan Kumar to the house of Bikau Mukhia in the name of treatment and thereafter, his dead body was found in the wheat field of co-accused Jhagru Baitha. Patna High Court CR. MISC. No.50600 of 2025(4) dt.31-10-2025 2/2 suspects that all the F.I.R. named accused persons, including this petitioner, committed murder of his son.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case only on suspicion. Petitioner is only alleged to be last seen with the deceased and informant is not an eye witness of the occurrence. He further submits that dead body of the deceased was found in the wheat field and petitioner has got no concern with the aforesaid wheat field. Petitioner is in custody since 02.04.2025.

Learned counsel for the informant vehemently opposed the bail application and submitted that there is specific accusation that this petitioner along with co-accused Bikau Mukhia took the deceased with them and thereafter, his dead body was recovered. During investigation, burnt pieces of the clothes worn by this petitioner were recovered from the place of occurrence.

6. Considering the nature of accusation and gravity of the offence, prayer for bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Navya/- U T
