JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but from perusal of the impugned order it goes to show that petitioner was arrested in connection with Kundwachanipur P.S.Case No. 19 of 2015 in which he confessed his guilt disclosing his involvement in the present case and except the aforesaid confessional statement as well as criminal antecedent of ten cases, there appears to be nothing against the petitioner. The investigation against the petitioner has already been completed but it appears that the investigating officer never made any attempt to arrange the T.I.P of the petitioner.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two

Patna High Court Cr.Misc. No.47348 of 2016 (2) dt.09-12-2016 2/2 sureties of the like amount each to the satisfaction of learned Judicial Magistrate,1st class, Raxaul at Motihari in connection with trial no. 1040 of 2015 arising out of Chhauradano P.S.Case No. 14 of 2015.
