Petitioners seek bail in connection with Sikarhatta P.S. Case No. 55 of 2017 registered for the offence punishable under sections 409, 420 of the Indian Penal Code. Learned counsel appearing for the petitioners submits that petitioners, who are Up-Mukhiya and members of Appointment Committee of Anganbari Servika/Sahayika, have falsely been implicated in this case due to ulterior motive. They have not committed any forgery and they have only discharged their duty. Similarly situated co-accused namely, Gauri Shankar, who is Mukhiya of the Gram Panchayat has been granted bail by a Co-ordinate Bench of this Court vide order dated

Patna High Court Cr.Misc. No.58298 of 2018(2) dt.28-09-2018 2/2 08.12.2017 passed in Cr. Misc. No. 57524 of 2017, as contained in Annexure-5. Petitioners have no criminal antecedent and are in custody since 18.08.2018.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Bhojpur at Ara in connection with Sikarhatta P.S. Case No. 55 of 2017.
