The petitioner seeks bail in connection with Kotwali P.S. Case No.04 of 2019 registered under Section 394 of the Indian Penal Code besides Section 27 of the Arms Act. Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that on the basis of the written report of the informant, the present case was lodged against Harsh Singh Rathore alias Baban, Miku Shah and some unknown on the identification of the aforesaid accused in CCTV Footage and the name of the petitioner was not surfaced till the lodging of the present case. Further submission is that no incriminating was recovered from the possession of the petitioner and the petitioner is in custody since 19.03.2019. In fact, the petitioner is accused in 11 other cases, as detailed in paragraph-3 to this application, due to that reason, the police got managed to implicate the petitioner in the present case, showing the confessional statement of the coaccused Sonu Kumar. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Kotwali P.S. Case No.04 of 2019. Out of the two sureties, one must be either parents or the close relative of the petitioner.
