JUSTICE ARVIND SRIVASTAVA ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is an accused in Alipur P.S.Case No.4/16 registered under Section 498(A)/34 of the I.P.C. and Sections 3⁄4 of Dowry Prohibition Act.

The accusation against the petitioner is of demand of dowry and torture the informant (wife) on account of nonfulfillment of the demand. Submission of the petitioner is that the informant wanted to establish her separate matrimonial home which is not possible for the petitioner as he is poor person, whereafter she herself went to her parental house and she has been staying there.

Patna High Court Cr.Misc. No.53606 of 2016 (2) dt.21-12-2016 2/2 She is not ready to return to her matrimonial house. Looking to the facts and circumstances of the case, let the petitioner, abovenamed, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the S.D.J.M., Gaya, in Alipur P.S. Case No.4/16.
