The petitioner seeks bail in Bhabua P.S. Case No. 260 of 2021, Gr. No. 756 of 2021, registered for the offence under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, on the instigation of this petitioner, co-accused Santosh Bind shot dead the son of the informant.

It is submitted on behalf of petitioner that as per F.I.R. itself, specific allegation of firing is against co-accused Santosh Bind. Petitioner is only alleged to be one of the instigator and he is in custody since 04.08.2021.

However, learned counsel for the informant and State have opposed the bail petition and submitted that petitioner is named in the F.I.R. and he is one of the instigator.

Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Kaimur at Bhabua in connection with Bhabua P.S. Case No. 260 of 2021, Gr. No. 756 of 2021 (as stated in paragraph - 2 of the supplementary affidavit).
