JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-08-2019 This application, for grant of anticipatory bail, arises out of Mohaniya P.S. Case No. 160 of 2019, disclosing offences under Sections 366A of the Indian Penal Code. Petitioner is named in the F.I.R. as the person, who kidnapped the minor daughter of the informant. Submission of learned counsel for the petitioner is that the statement of the girl has been recorded under Section 164 Cr.P.C., in which, she has not named the petitioner rather she named one Chandan Kumar and her statement further disclosed that her parents were pressurizing her for marriage, whereas, she wanted to study, as such, she fled away, she disclosed her age as 17 years and the court below has also assessed her age as 17 years.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua, in connection with Mohaniya P.S. Case No. 160 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
