2. The petitioner seeks bail in a case registered for the offence punishable under Sections 108, 3(5) of the B.N.S.

3. The allegation in the first information report is that the informant's wife committed suicide and has claimed that the petitioner is responsible for the said suicide as he used to contact her and tease her in his absence and also used to extort money from her by blackmailing her.

4. Learned counsel for the petitioner submits that the deceased was a tenant in the house of his uncle as such was very well known to the petitioner and they were sharing very cordial relation, as such there is no reason why the petitioner would

It is an admitted position that the deceased was school teacher and was also a mother of two children and also in such view of the matter, there is no question of teasing the deceased. It was rather the petitioner who had informed the husband about his wife having jumped into river for reasons best known to her, whereafter the informant came and lodged the present case making the petitioner an accused in the said case. The materials collected during the course of investigation do not disclose any specific evidence with regard to any teasing or extortion and paragraph 38 of the case diary which is the statement of Kanchan Kumari, who was also a tenant in the same house has rather stated that the petitioner and the deceased were on talking terms and had very cordial relations and the deceased also used to go to his house, however the petitioner is in custody since 06.05.2025 and charge-sheet has already been submitted and has no criminal antecedent.

5. Learned APP for the State as well as learned counsel for the informant have opposed the grant of bail. However, learned counsel for the informant has also filed a counter affidavit in order to oppose the present application.

No.50668 of 2025(4) dt.28-11-2025 3/3 also considering the fact that no substantive material has been indicated during the course of investigation against the petitioner to establish any bad or strained relationship between the petitioner and the deceased much less there being any proximate or live link of any act of petitioner leading the deceased to commit suicide, coupled with the fact that the petitioner is in custody since 06.05.2025 and is a student having no criminal antecedent, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Birpur/concerned Court below in connection with Birpur P.S.
